Terms of Service

“Platform” or “Service” means the Sahayogi website, applications, and related services operated by Impact Tech Hub.

“User”, “you”, or “your” means any person who accesses or uses the Platform, whether as a property seeker, owner, tenant, agent, builder, or organization member.

“Listing” means any property, unit, or related offering posted on the Platform. “Content” means any text, images, documents, or other material submitted to the Platform by a User.

“Organization” means an agency, builder, or other business entity registered on the Platform, and its authorized members.

By accessing or using Sahayogi, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

We record the version of these Terms you accept at registration. If you use the Platform on behalf of an Organization, you represent that you are authorized to bind that Organization to these Terms.

You must be at least 18 years old and legally competent to enter into a binding contract under the laws of Nepal to use Sahayogi.

By using Sahayogi, you confirm that you meet these requirements and that all information you provide is truthful, accurate, and current.

Sahayogi is an online platform that connects property seekers, owners, tenants, agents, and builders, and provides tools to list, discover, negotiate, and manage properties and rental arrangements.

We act only as an intermediary. We are not a party to, and do not guarantee, any tenancy, sale, negotiation, payment, or other transaction between Users. We do not own, sell, let, manage, or inspect any property listed on the Platform.

No agency, partnership, employment, or joint-venture relationship is created between you and Impact Tech Hub by your use of the Platform. Any dealings you have with other Users are solely between you and them, and you engage with them at your own risk and discretion.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly at support@sahayogi.io if you suspect any unauthorized use.

You must provide accurate and complete information when registering and keep it up to date. You may not create an account using another person’s identity or share your account without authorization.

You are responsible for the acts and omissions of any person you authorize to use your account or act on behalf of your Organization.

Agents, builders, and Organizations may be required to complete identity or business verification (KYC) before listing or accessing certain features, and to submit supporting documents for this purpose.

Verification is a limited check carried out for platform integrity. A verified badge or status is not an endorsement, recommendation, or guarantee by Impact Tech Hub of any User, Listing, or transaction, and you should carry out your own due diligence before entering into any dealing.

You are solely responsible for the Content and Listings you post. You must ensure they are accurate, lawful, not misleading, and kept current, and that you own the property or are otherwise authorized to list, let, or sell it.

You represent and warrant that you own or have all necessary rights to the Content you submit (including photographs and documents) and that it does not infringe the rights of any third party or violate any law, and does not discriminate unlawfully against any person.

You grant Impact Tech Hub a non-exclusive, royalty-free, worldwide license to host, store, reproduce, adapt, and display your Content for the purpose of operating, promoting, and improving the Platform. This license ends when the Content is removed, except to the extent it must be retained to comply with law or for records of completed transactions.

We may review, moderate, refuse, or remove any Content or Listing at our discretion, including where it breaches these Terms or applicable law, but we are under no obligation to monitor Content and do not guarantee the accuracy of any third-party Listing.

You agree not to: post unlawful, fraudulent, misleading, or infringing Content; list properties you have no right to list, or post fake or duplicate Listings; harass, threaten, defame, or discriminate against other Users; or misrepresent your identity or affiliation.

You further agree not to: scrape, harvest, or copy data from the Platform; reverse-engineer, interfere with, overload, or attempt to gain unauthorized access to the Platform or its systems; circumvent any fee, security, or access control; or use the Platform to send spam or unsolicited communications.

You will comply with all applicable laws of Nepal, including those relating to property, tenancy, consumer protection, taxation, and electronic transactions, in your use of the Platform.

Sahayogi is not a payment processor and is not a party to any rent, deposit, commission, or other payment between Users. Payments are made directly between the parties; any payment records, receipts, QR codes, or reminders on Sahayogi are provided for convenience only and are not proof of payment or a financial service.

Where Sahayogi records tax withholding (such as TDS on rent) or generates related statements or certificates, these reflect figures entered by the parties and do not constitute tax, legal, or accounting advice. You are responsible for your own tax obligations and for verifying all such figures and documents with a qualified professional before relying on or filing them.

Any dispute over amounts, rent, deposits, refunds, commissions, or payments is solely between the parties involved. Impact Tech Hub is not responsible for collecting, holding, disbursing, or refunding any such amounts, or for resolving any such dispute.

The Platform, including its software, design, text, graphics, logos, and trademarks (other than User Content), is owned by or licensed to Impact Tech Hub and is protected by applicable intellectual-property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for its intended purpose. You may not copy, modify, distribute, sell, or create derivative works from any part of the Platform except as expressly permitted.

The Platform may reference or integrate third-party services (such as payment wallets, maps, or communication tools) and may contain links to third-party websites. We do not control and are not responsible for third-party services or content, and your use of them is subject to their own terms.

You may stop using the Platform and request deletion of your account at any time, as described in our Privacy Policy.

We may suspend, restrict, or terminate your access to the Platform, or remove your Content, with or without notice, if you breach these Terms or applicable law, if required by a competent authority, or to protect the Platform or other Users.

Provisions that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and governing law — will continue to apply.

The Platform is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including as to accuracy, availability, fitness for a particular purpose, or non-infringement, to the fullest extent permitted by law.

We do not warrant that the Platform will be uninterrupted or error-free, or that any Listing, User, verification status, or information on the Platform is accurate, complete, or reliable. You rely on the Platform and on other Users at your own risk.

To the fullest extent permitted by law, Impact Tech Hub and its directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or business, arising out of or relating to your use of the Platform or any transaction or dispute between Users.

To the fullest extent permitted by law, our total aggregate liability arising out of or relating to the Platform will not exceed the greater of the amount of fees you paid to us for the Service in the three (3) months before the event giving rise to the claim, or NPR 10,000.

Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited, including liability for fraud, or your rights under the applicable consumer-protection law of Nepal, which remain unaffected.

You agree to indemnify and hold harmless Impact Tech Hub and its directors, employees, and agents from any claim, demand, loss, or expense (including reasonable legal fees) arising out of your Content, your use of the Platform, your breach of these Terms or applicable law, or your dealings or disputes with other Users.

Our collection and use of your personal information is governed by our Privacy Policy, which forms part of these Terms. By using the Platform, you consent to the practices described in it.

We may modify, suspend, or discontinue any part of the Platform at any time.

We may update these Terms from time to time. Where changes are material, we will take reasonable steps to notify you. The “last updated” date shows when the current version took effect, and your continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.

These Terms and any dispute arising out of or relating to them or to the Platform are governed by the laws of Nepal.

The parties will first attempt to resolve any dispute amicably through good-faith discussion. If a dispute cannot be resolved within a reasonable period, it will be subject to the exclusive jurisdiction of the competent courts of Kathmandu, Nepal, without prejudice to any right you may have to bring proceedings before the consumer-protection or other authority having jurisdiction under Nepali law.

Neither party is liable for any failure or delay caused by events beyond its reasonable control, including natural disaster, power or network failure, or acts of government.

If any provision of these Terms is found unenforceable, the remaining provisions continue in full effect. Our failure to enforce any right is not a waiver of it. You may not assign your rights under these Terms without our consent; we may assign ours to an affiliate or successor.

These Terms, together with the Privacy Policy, are the entire agreement between you and Impact Tech Hub regarding the Platform. You agree to receive notices and communications from us electronically. These Terms are published in English and Nepali; in case of any inconsistency, the English version prevails for interpretation.
